Supreme Court Judgment: No Harassment to Alternative Medical Practitioners, Hon’ble Supreme Court Of India. Latest contents of judgment of Hon’be Supreme court of India SLP (Civil) No. 11262/ 24/11/2000 (In the judgment and order date 18/11/1998 in F.A.Q. No.205/92). For want of certain clarification etc. Delhi govt. & union of India (ministry of health & family welfare) filed an appeal (SLP) in the Hon’ble Supreme Court of India challenging the order of Hon’ble Delhi High Court dated 18/11/1998 upon hearing on 12/11/2000. The division bench of Hon’ble Justice R.C. Lahoti & Hon’ble Justice Shivraj V. Patil rejected the plea of Delhi govt. & union of India. Finally, on 24/11/2000 the bench of Hon’ble court comprising Justice Rajendra Babu and B.N. Agarwal directed to entertain the matter and the SLP filed by petitioner was dismissed. The Supreme Court also maintained that the status quo of Hon’ble Delhi High Court (FAO205/92) dated 18/11/1998 must remain, allowing legally constituted institutions imparting education in Alternative Medicines to issue diplomas/certificates, whose holders are entitled to practice the covered faculties.

1. According to the High Court of Chennai, RMP certificate holders can practice in alternative medicine only; they cannot practice surgery, obstetrics, radiation therapy, or prescribe certain drugs.
2. The Council of Alternative System of Medicines run by Iatros Medical Society has conferred with alternative medicine & paramedical colleges, research centers, and hospitals across India.
3. Promotes research & development in alternative medicine and paramedical science for dissemination of knowledge.

Legal Grounds & Court Declarations

• Karnataka High Court: Recognized that no permission is required under any statute to develop, propagate, or promote alternative medicine (WPs 17534-96/94 & 36960/94).
• Delhi High Court: Govt. must take action to regularize and recognize alternative medicine (Judgment 18/11/1998, CWP No. 4015/1996 & OM No.8468/1997).
• Calcutta High Court: Affirmed constitutional rights and legal validity of alternative medicine (Final Judgment 07/05/1990, CLJ 1991 (2) 173-187).
• Supreme Court of India: Confirmed Delhi High Court judgment must be followed within eight weeks. Dismissed SLP (Civil) No. 11262/2000 filed by Union of India & Delhi Govt. dated 24/11/2000.

• 28/11/2016: Madras High Court reaffirmed that practitioners can rightfully practice Electro Homoeopathy without local permissions.
• Rajasthan Govt. established committee for legal & scientific analysis, ultimately recommending recognition of Electro Homoeopathy; Bill No. 13 of 2018 passed on 10/10/2018.
